Bigger Trading Ltd. t/as 'BiggerJugs' is committed to protecting your online privacy while providing you with the most useful and usable browsing experience possible. While you can use many features of the BiggerJugs.co.uk website anonymously, you are required to provide personal information to gain access to some of our content and services.

How we collect and use personal information

Registering for membership on BiggerJugs gives you access to all the site’s customer facilities and features. The information required is your name, telephone number, e-mail address, and geographic address including country and postal code. Should you wish to purchase from us, we will need to collect credit or debit card information.

We use credit or debit card information to take payment for orders placed by you with us, to refer to in case of query, and [being a business transaction] to preserve in archive as required by law, and as required by our Payment Processors. We use a third-party processor [ProTX] to do this, and we do not retain your card information on our servers.

We use your geographic address as a delivery and/or billing address for goods or services that you have ordered.

We use your telephone number to contact you if we have an urgent query concerning an order that is being processed, or if you have specifically asked us to call.

We use your email address to send any query we have regarding an order that is being processed, and may use it to inform you about the progress of an order through our fulfillment system.

We use your email address to respond to any query that you have made. If any further emails are sent to the email address you have given, they will be related to the original query, or to a follow-up question you have asked.

Newsletters (opt in, opt out permitted at any time)

With your specific and separate approval, we may send newsletter e-mails to notify you about news, offers, important changes to the site, and new services. By default you are NOT subscribed to these newsletters, and you may subscribe or unsubscribe when you create an account or any time you modify your account.

One-off emails On rare occasions, we may send individual emails [not newsletters] to your email address on an individually crafted, personal, one-to-one basis.

We respect that you spend time reading anything we send you, and we do not make uninvited use of your time casually!

Spamming

We do not send marketing-related emails on behalf of third parties.
We do not send our own marketing-related emails if you have selected the option not to receive them.
We do not sell or rent-out our email lists.
We do not buy or rent-in email lists (if no-one bought the lists, spammers would be out of business).

Data protection

We balance the needs of running our business, including complying with data retention laws, with the needs of providing sufficient privacy and security to gain the long term trust of our customers. We do this by diligently striving to improve the security of the browsing experience that we offer and the security of our back-office systems, particularly in the areas relating to transactions.

This work is carried out within the framework of the eight principles of the Data Protection Act 1998. We fully comply with these principles.

How we protect your personal information

All personal data you enter on the BiggerJugs website is encrypted (SSL) that encodes the information before your Web browser sends it to us. The encrypted SSL information is decoded only after it reaches our server, meaning hackers can’t snatch any of your personal information while it is in transit.

Once the data reaches our site, the same state-of-the-art security that we use to guard all of our company’s essential business data protects your personal data as well. The details of this system is commercially confidential, but adheres to good business practice.

How we use cookies

As you probably know, "cookies" are small pieces of information that some Web sites store on your computer's hard drive when you visit them. Like many other Web sites, BiggerJugs may use cookies to identify members so they don’t have to enter a user ID and password upon each visit.

What information we share with third parties

BiggerJugs does not provide any third-party access to your personal information except as follows: We provide access to your personal information to ProTX Ltd., who are our current card authorizers and payment processors.

We may provide access to your personal information to alternative authorizers and/or payment processors, providing that Bigger Trading Ltd. has a formal business arrangement in place with them for this purpose, and that the Financial Services Authority regulates the payment processor concerned under English law.

To facilitate your own attempts to register with our partners or receive offers from select partners as mentioned elsewhere in this policy, we may provide third parties with aggregate statistics about our customers, traffic patterns, and related site information. This data reflects site usage patterns gathered during customer visits to our Web site each month, but it does not contain behavioral or identifying information about any individual member unless that member has given us permission to share that information.

Obtaining your consent

By using our Web site, you give BiggerJugs permission to collect information about the pages served to you as an anonymous user for the purpose of calculating aggregate site statistics. If you register at BiggerJugs, you authorize BiggerJugs to use information you provide to personalize the information we deliver to you and to use your demographic information when calculating aggregate customer data. As a registered member, you give BiggerJugs and our agents permission to send you e-mails related to the subscription e-mail services to which you subscribe.

If you are under the age of 18, you must not provide your name, e-mail address, or any other identifying information without the consent of your parent or guardian, or as otherwise provided for by applicable law. For our part, BiggerJugs does not target minors within advertising campaigns.

Distance Selling Regulations

Under Statutory Instrument 2000 No. 2334 The Consumer Protection (Distance Selling) Regulations, we are pleased to furnish the following information.

This business is operated by Bigger Trading Ltd trading as 'BiggerJugs', a Limited Liability private company registered in England & Wales, company No. 06720422. The address to which documents may be effectively served is Unit 1, Harts Close, ILMINSTER, TA19 9DJ.

The main characteristics of each product, and the cost (excluding delivery, but including all applicable taxes), may be found on the corresponding product page for the product concerned. Prices and discounted prices will remain valid once an order has been made using the sales mechanism on the BiggerJugs.co.uk website, subject to product availability, order acceptance, and correct ticketing. These regulations confer a right of cancellation.

Terms and Conditions of Sale

1. DEFINITIONS

"BiggerJugs" or "BiggerJugs.co.uk" or "we" or "us" means Bigger Trading Ltd trading as 'BiggerJugs'. The "purchaser" or "customer" means the person, firm, company or agent ordering or buying goods or services from BiggerJugs. The "Goods" mean the products of the relevant order of sale. The "Price List" is the list of goods and their relevant selling prices in United Kingdom Pounds Sterling published by BiggerJugs in any format. BiggerJugs reserve the right to alter published prices without prior notice. "Consumer" means a private person buying Products for private use. If you are a Consumer, please find your specific rights and exceptions in Section 11.

2. ACCEPTANCE OF ORDERS

BiggerJugs reserves the right to reject any order received for goods at our sole discretion and without explanation.

3. VARIANCE OF TERMS OF SALE

Any order received that wishes to amend these terms is subject to written confirmation by BiggerJugs.

4. FORMATION OF CONTRACT TO SUPPLY GOODS

A contract to supply goods is not formed until a valid order has been received by BiggerJugs, and BiggerJugs has manually confirmed acceptance of the order or payment has been accepted by BiggerJugs. Payment is considered as being accepted if a charge has been made against the credit or debit card of the purchaser, or if a cheque offered by the purchaser in settlement has been presented for payment and has been honoured.

5. PAYMENT & TITLE

The goods remain the property of BiggerJugs until all due funds relating to the goods have cleared. Payment may be made by the following methods: cash, personal cheque, company cheque, banker's draft, cashier's cheque, certain credit cards, certain debit cards or electronic transfer of funds into an account nominated by BiggerJugs.

6. CREDIT

Unless credit facillities have been granted, all monies due must be received by BiggerJugs before the goods can be supplied. Where credit accounts have been granted the purchaser agrees that they will pay all outstanding monies (by the methods outlined in section 5 except credit cards) within the time limit stated on the invoice. In the event of non or late payment the purchaser agrees to pay an administration fee of 10% of each overdue invoice value (minimum £10) and BiggerJugs or its representatives may enter the purchaser's premises at any reasonable time in order to recover goods originally supplied by BiggerJugs for which payment is outstanding beyond any previously written and agreed credit term. BiggerJugs reserves the right to withold future despatches and/or revoke credit facilities on a temporary or permanent basis.

7. SUITABILITY OF USE

Due to the care and craft skill being needed to use many of our products, we are unable to guarantee the suitability of any item for a specific purpose, unless the customer seeks specific advice from us in writing prior to purchase.

8. DEFECTIVE PRODUCTS

New products supplied by BiggerJugs are warranted to be free from defect for a period of one year or until the Best Before Date (whichever is the sooner) unless otherwise specified in writing. Defective items may be returned to BiggerJugs, and BiggerJugs may replace, issue a credit note or repair the goods at BiggerJugs sole discretion within a time period specified by BiggerJugs. BiggerJugs is not responsible for goods returned to us that are lost, or further damaged in transit. Negligence, misuse, or failing to take reasoanable care of any item will negate the warranty.

9. CONDITION OF RETURNED, DEFECTIVE GOODS

Defective goods returned under clause 8 must be returned with original packaging and with a copy of the original invoice or sufficient information to allow us to trace the original invoice details. Goods returned otherwise will, at our discretion, either be refused or subject to restocking fee to cover our expense. Goods returned as defective and found to be fault free will be returned to the customer at the customer's expense.

10. NON-DEFECTIVE PRODUCTS

Non-defective goods may be returned at the discretion of BiggerJugs. However these goods must be returned unused with original packaging, a copy of the original invoice or sufficient information to allow us to trace the original invoice details, and in a clean and resalable condition. Goods returned otherwise will, at our discretion, either be refused or subject to restocking fee to cover our expense.

11. CONSUMER RIGHTS

If you are a Consumer (as recognised by the EU Distance Selling Directive) you may cancel your mail order purchase at any time within 7 working days of receipt without cause and receive a refund of the price paid excluding carriage charges. To do this you must inform us in writing and return the products immediately, in the same condition you received them and at your own cost and risk. Any statutory Consumer rights are unaffected by this Agreement. This clause does not apply to any trade customer, user or reseller.

12. CANCELLATION OF ORDER

The purchaser may cancel the order for any normal stock items that have not been shipped. The purchaser may not cancel orders for items which have been specially ordered or specially manufactured for the purhaser.

13. DELIVERY

BiggerJugs will make its best endeavors to deliver all goods as instructed by the purchaser, or (where instructions have not been received and accepted by us) as published by BiggerJugs. BiggerJugs will not be responsible for late deliveries outside of its control, howsoever caused.

13a. PLEASE NOTE. For your security we have transparent security checks in operation. In the event that any order placed over the internet fails one of these checks, your order will be suspended until we can confirm its validity.

14. DAMAGE IN TRANSIT

The purchaser shall inspect all goods immediately they are delivered. In the event of loss/shortage/damage BiggerJugs should be informed within 4 working days by use of the 'Contact' facility or email of the discrepancy, and (if requested) in writing within 7 working days. BiggerJugs reserves the right to reject claims for incorrect delivery made later than 7 days after the due date for delivery.

15. FORCE MAJEURE

BiggerJugs reserves the right to cancel, suspend or vary the operation of contract of sale if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing) fire, flood, storms, plant breakdown, strikes, lock outs, riot, hostilities, non-availability of material or suppliers or any other event outside the control of BiggerJugs. BiggerJugs shall not be held liable for any breach of contract resulting from such an event.

16. JURISDICTION

In matters of dispute, it is agreed that the Laws of England shall have jurisdiction.

17. MISCELLANEOUS

If any part of the Agreement is found to be invalid or unenforceable by a court, the remainder is unaffected. BiggerJugs may subcontract, assign or transfer its obligations or rights to a competent third party whether in whole or in part. The purchaser may not assign or transfer any of their obligations.

18. PICTURES AND DESCRIPTIONS

Pictures and descriptions (where applicable) are intended to be closely representative of the goods being offered for sale. However, pictures and descriptions are subject to change without notice and therefore should not be viewed by the purchaser as an exact description of how the goods will be supplied. If an exact and up-to-date description is of the essence, then the purchaser should contact BiggerJugs, who will endeavour to furnish the information required. BiggerJugs reserves the right to adjust the product specifications in any of their publications.

Information and pictures contained in all literature supplied by BiggerJugs (in any format including but not limited to Websites, email and paper) are copyright to BiggerJugs or used under licence, and may not be reproduced in any format without the written permission of BiggerJugs.
